1. PURPOSE AND ACCEPTANCE
These Terms and Conditions constitute a binding agreement between the user and Pronunciation with Emma (the “Company”) for access to and use of digital content and services offered via its website and associated platforms. By registering or using the services, the user confirms having read, understood, and fully accepted these terms.

2. DEFINITIONS
"User": any natural or legal person accessing the services.
"Services": materials, courses, live classes, and digital resources provided by the Company.
"Platform": the digital environment accessible online where the Services are offered.

3. USER REGISTRATION AND ACCOUNT
Use of the Services requires the creation of a personal account. The user agrees to provide truthful information and to maintain the confidentiality of their credentials. Fraudulent, shared, or improper use of the account may result in immediate suspension or cancellation without refund.

4. DESCRIPTION OF SERVICES
The Company provides access to digital educational content, interactive workshops, live classes, recordings, forums, and other complementary materials focused on learning English, with a particular emphasis on pronunciation. Access may be limited depending on the subscription level.

5. USER OBLIGATIONS
The user agrees to:

Use the Services in accordance with the law and these Terms.

Refrain from copying, distributing, or recording content without express authorization.

Not perform actions that may damage, overload, or compromise the Platform’s security.

6. PRICE, BILLING AND PAYMENTS
All prices are expressed in euros and include applicable taxes unless otherwise indicated. Payment for Services shall be made in advance through the methods enabled on the Platform. In the case of subscriptions, charges will recur until cancelled by the user. Failure to pay will result in automatic suspension of access to the Services.
7. RIGHT OF WITHDRAWAL AND REFUND POLICY

No refunds are provided.
EMMA'S PRONUNCIATION HUB
The User has 14 calendar days from enrolment to withdraw from the service, provided that 15% or below of the course has been accessed.
Withdrawal must be communicated in writing via email to [email protected].
Outside this period, refunds will not be granted except for justified cause. The Company reserves the right to deny refunds in cases of abusive use or breach of the Terms.
No refunds are provided for failing to cancel subscriptions, even if the service has not been used.
THE CONFIDENT COMMUNICATOR
All payments are final. By choosing a payment plan (if offered), the Student agrees to complete all scheduled payments, even if they decide to pause or stop attending sessions.
Failure to complete payments will result in a temporary suspension from The Confident Communicator for up to 7 days until the outstanding balance is received. If payment is not made within this period, access will be permanently revoked with no right to rejoin or continue.
Refunds are available only under the following conditions:

Before the first session: Refunds are possible minus a €200 administrative fee if no diagnostic assessment, Welcome Call, or first session has taken place.

After the first session: Refunds are possible minus a €200 administrative fee if requested after the first session and before the second.

After the second session: No refunds will be issued under any circumstances.

Performance Guarantee:Â If, after completing all sessions and assignments, the Student has not improved in at least one area identified in their initial pronunciation assessment, they will be entitled to a complimentary 60-minute private coaching session with Emma.

8. DURATION, SUSPENSION AND TERMINATION
This agreement shall remain in force as long as the User maintains an active account or accesses the Services. The Company may suspend or terminate access in case of breach of these Terms, fraudulent activity, or legal reasons. The User may cancel their account at any time from their profile.

9. LIMITATION OF LIABILITY
The Company shall not be liable for:

Technical failures beyond its control.

Indirect damages, data loss, or lost profits.

Unauthorized third-party misuse of the account.
In no case shall the Company’s overall liability exceed the amount actually paid by the User in the past 12 months.

10. DATA PROTECTION AND PRIVACY
Personal data processing is carried out in accordance with the General Data Protection Regulation (GDPR). The Company only collects data necessary to provide the service, as outlined in its Privacy Policy available on the Platform.

11. GOVERNING LAW AND JURISDICTION
These Terms shall be interpreted in accordance with Spanish law. For any disputes arising from the use of the Services, the parties submit to the Courts of the city of Barcelona.

12. DISPUTE RESOLUTION
Before going to court, the parties agree to attempt amicable resolution. The User may also turn to alternative dispute resolution platforms, such as the European Commission’s ODR system.
